DEFINITIONS

GSS — a legal entity registered under the laws of Washington D.C. and the USA, Global Spark Solutions PLLC, business address: 2503 Easie Street, Oakton, Virginia, 22124;
user — any legally capable natural person (‘data subject’), who intends to receive the GSS services and/or receives the GSS services and/or uses the website https://globalsparksolutions.com;
website – the website https://globalsparksolutions.com;
personal data — any information relating to an identified or identifiable natural person;
processing — any operation which is performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, etc.

CONTROLLER

PURPOSES AND BASIS OF THE PROCESSING

We process the below-described categories of user’s personal data:● first, middle and last name;● passport details (in particular passport series, number, issuing authority, date of issue and/or identification code);● date of birth;● banking details;● e-mail address;● telephone number;● identification information of the data subject regarding the object of IP rights and/or property;
metadata (e.g. date, the time when the person called GSS, cookies).
In most cases, we process your personal data for the purpose of provision of services and rely on the performance of a contract (or in order to take steps at the request of the data subject prior to entering into a contract) as a basis for the processing.
In some cases (concerning your e-mail, first, middle and last name), we use your personal data for the purpose of marketing communications and rely on the user’s consent and/or legitimate interests to provide updates on services provided to the user or other related services that might be of the user’s interest (considering that the user has the ability opt-out) as a basis for the processing.
We use metadata only for the analyses of the traffic and use of the website and rely on the user’s consent and/or legitimate interests to improve GSS services as a basis for the processing.

Additionally, GSS may process any other personal data provided voluntarily by the user. The user is not obliged to provide personal data by law or under any agreement, however, GSS services might not be available or might be impossible to be provided without some types of personal data.
GSS retains and processes the user’s personal data as long as it is necessary to fulfill the purposes defined and the basis of the processing activity exists, or until a request to delete personal data is received.

TRANSFER OF PERSONAL DATA

When necessary, personal data may be disclosed by GSS in order to support its activities and to fulfill the purpose of processing personal data to such third parties:
a) translators, forensic experts and/or specialists, lawyers and/or patent attorneys and/or attorneys at law including those operating within the jurisdiction outside the USA, particularly in Ukraine or the EU;
b) offices and other public authorities of EU, Ukraine or the USA;
c) representation of GSS in Ukraine, particularly, IPStyle LLC, IPStyle Patent Law Company LLC, IPStyle Attorneys Association;
d) third parties that perform GSS customer traffic analysis, for example, Google Analytics.
This list is not exhaustive and, if necessary, may be expanded solely for the purpose of providing GSS services, about which GSS notifies the user.

PROCESSING OF PERSONAL DATA

GSS is processing user’s personal data by automated means; personal data is kept in electronic form on the website, in CRM-system and on computers in the form of Excel files with extension .xls or .xlsx, access to which only authorized GSS employees and partners at GSS business address and the location of representation of GSS in Ukraine (61 Mezhyhirska, Kyiv, Ukraine, 04071) and Portugal (Mercado de Ribeira, Av. 24 de Julho 1o andar, 1200-479 Lisboa, Portugal).
The user’s personal data is not subject to automated decision-making, including profiling.

USER RIGHTS

User has the right:● to access its personal data processed by GSS;● to rectify (modify) its personal data;● to erase its personal data (‘right to be forgotten’);● to restrict the processing of personal data when giving consent or by sending an appropriate request to GSS via the email address indicated in the Contacts section;● to object to the processing of personal data;● to obtain and reuse its personal data for its own purposes (right to data portability);● to withdraw consent for the processing of personal data by sending an appropriate request to GSS via the email address indicated in the Contacts section if the processing activity is based on the user’s consent;● to unsubscribe from receiving GSS email newsletters and other marketing materials. To do this, it is necessary to follow the instructions specified in the e-mail received by the user;● to lodge a complaint with a supervisory authority.

REQUEST. DELETION AND MODIFICATION OF PERSONAL DATA

If necessary, any user may email ______ to make changes to their personal data, to request information about its processing, and to send requests for other issues related to the processing of personal data. In the case of the consent withdrawal and personal data removal, the user may request so by emailing ______. In the case of a notice of consent withdrawal and removal of personal data, GSS undertakes to remove such data within 30 days after the identification of the user.

In the case of a request as provided in the previous paragraph, GSS has the right to contact the user by telephone or by e-mail in order to carry out such identification, if necessary, in order to confirm the user’s actions outlined in the previous paragraph.

USE OF COOKIES

GSS uses cookies to record the type of browser and operating system, the page from which the user came to the current page, the path through the pages on this website, and the domain of the Internet service provider in order to understand how users use the website. GSS uses cookies to track user settings and preferences. Cookies are also used to improve the navigation of the website and to tailor information that is more relevant to the user.

On the website we use only statistics cookies (__site-stat__; _ga; _ga_#; wba_user_id). Statistic cookies help GSS to understand how users interact with the website by collecting and reporting information anonymously. The statistics cookies usually expire in 1-2 years. Some of them (__site-stat__) are persistent.

GSS encourages all website users to make sure that their browser settings match their desire to accept cookies or not. The user may set the browser to warn before accepting cookies or to reject them immediately. Accepting cookies is not a prerequisite for navigating and using the GSS website.
